MARTINE E.V. VAN KRIEKEN-BOERSMA, LLM, PHD

Attorney-at-law

SPEE advocaten & mediation Maastricht

In 2011, I was sworn in as a practising lawyer, and have had the great pleasure of spending much of my career as an attorney-at-law working at SPEE advocaten & mediation. I advise and litigate about partnership and company law, labour law, the law of obligations, contract law and property law. As well as private individuals, I also advise many different companies, from multinationals to self-employed entrepreneurs.

.
I graduated with distinction from the Grotius specialist training in Partnership and Company Law. This means you contact me for drawing up or assessing shareholder agreements, domestic and international contracts, and general terms and conditions. You can also contact me for assistance with business acquisitions or the disbanding of partnerships, or with issues in the area of directors’ liability.
.
Furthermore, I am very experienced in labour law. I provide guidance in individual employment law processes, for example in cases of underperformance or discussions about illness and incapacity for work. I gained a lot of experience with the dismissal of statutory directors. In that regard, I assist directors, but I also regularly assist shareholders and supervisory boards, to determine the strategy in advance. I also advise on group redundancies and collective and individual employment conditions. Moreover, I advise employers and employees on cross-border employment, for example if the employee works in the Netherlands but lives in Belgium or Germany. My personal style as a lawyer is analytical, pragmatic and solution-oriented, with a great involvement with my clients and a good understanding of the underlying relationships.
.
Before becoming an attorney-at-law, I worked in academia. After graduating in law from Maastricht University (with distinction), I completed a PhD in 2012 on the topic Corruption: a violation of human rights and a crime under international law?, for which I received the Max van der Stoel Human Rights Award in 2013. Furthermore, I held various board positions and taught students. Sharing knowledge is very important to me and therefore at SPEE advocaten & mediation, I run regular knowledge sessions, on various legal matters.
.
Clear language is obviously very important in the legal field. I therefore advise our international clients in English. Having passed the Cambridge Proficiency Exam (C2-level), international advice is in good hands with me. In 2023, I obtained my Bachelor of Arts in Spanish translation from ITV University of Applied Sciences for Interpreting and Translation. In addition to my work as a lawyer, I run my own business, Magister Translations: I am a freelance translator Spanish and English <> Dutch and I work as a copywriter. My knowledge and experience as a lawyer and as a translator/copywriter complement and reinforce each other.

I have registered the following areas of law practice in the rechtsgebiedenregister (register of legal practice areas) of the Netherlands Bar:
.

  • Company law;
  • Labour Law.

.
This registration requires me to obtain 10 training credits per calendar year for each registered area of law, in accordance with the Netherlands Bar standards.
